We are tenants dealing with a huge corporate management company…?
The apartment we rent was built in the 70’s. Our large kitchen window has been leeking water into our apartment when it rains. The amount of water is exessive, we go through about 10 towels cleaning up the water. We notiffied the manager and no action was taken to fix the problem. We then notified the property maitanance supervisor who assured us the window would be fixed imediatly. A man came out and looked at the window and said it would have to be completly replaced- and would give the company a bid , wich would need to be approved before doing any work. Well 2 weeks later and still no word. It is suppose to rain the rest of this week were we live. What can I legally Do? We first notified managment of the issue December 15 th.
First of all have all your complaints been done in writing to the management company? Verbal agreements will not hold up in court. Remember, the management company is informed that they need to replace the window and their next step is to get three bids to make sure they get the best price, trust me when I tell you that contractors are slow in getting bids to people as they are busy with larger contracts. This all takes time to gather, once they accept a bid then they have to schedule the contractor, it’s not uncommon for this process to take over a month to get scheduled if not longer. Not to mention the window might have to be special ordered and that could take weeks in itself.
If you do not get a response from the onsite manager then go to the person that will get you answers and that’s the property manager, not the onsite resident manager but the person over them that works in the corporate office. Somewhere listed is the name of the management company, usually its on the leasing sign outside i.e. managed by Faizon properties etc. Go online and locate their branch or corporate office and send the same letter to them. Make sure you do this in writing and you’ve kept a paper trail.
Be reasonable in your request, the management company can only move as fast as their contractors. Go in and find out if they have any updates regarding your window.
Google your tenant landlord laws usually windows have to be water and airtight so it is the responsibility of your landlord to repair or replace.
Have you done your notifications in writing via certified mail? Without that, you have no paper trail. Phone calls and verbals are worthless.

If you have notified your landlord as prescribed in your state ……he has now violated the terms of the lease regarding inhabitability……
Some states allow for the tenant to incur the cost of repair and then deduct it from next month’s rent……some states put a cap on that amount though…..google your state and landlord/tenant laws….
You are in position to notify your landlord that you are leaving because….cite the state laws he’s violated and that you expect your deposit returned in the amount of time dictated by state law……in AZ, landlords only have 14 days to return deposits…..

Dealing with any corporation sucks, they just want their money every month. you might eventually get your new window – when their good and ready. spend money on a lawyer if you want but they pay theirs more. you are what landlords call screwed blued and tatooed. your wet unhappy and locked in by a lease that works for them written by them. good luck with all that.
